Terms of Service
Last updated: 2026-10-31
These terms apply to the use of the software, the mobile app, the website and the services of FixturePilot. By installing or using our software or app, or by buying a licence, you agree to these terms.
1. Who we are
FixturePilot is a sole proprietorship of Stan Koolbergen, registered with the Dutch Chamber of Commerce (KVK) under number 98658115, VAT number NL005346627B93, established at Moestuinlaan 13, 1036 KD Amsterdam, the Netherlands, and reachable at support@fixturepilot.com.
2. Definitions
- Software: the software, the mobile app (FixturePilot for iOS and Android) and the services of FixturePilot.
- Licence: the right to use the software according to the chosen subscription.
- User: you, as a natural person or company using the software.
3. Licence and right of use
With a valid licence you receive a personal, non-transferable right to use the software. Depending on your type of licence (Individual or Teams) you may use the software on a limited number of devices or with a limited number of users. You may use the mobile app free of charge and without a licence; some features only work together with FixturePilot Desktop. You may not resell, rent out or copy the software for third parties, or try to circumvent or reproduce the licence check or the source code.
4. Subscription, prices and payment
Licences are offered as a subscription (monthly or yearly). Payment is handled by Mollie. Unless you cancel, your subscription is renewed automatically for the same period. If you are a consumer, a yearly subscription continues for an indefinite period after the first term, and you can then cancel it at any time with a notice period of at most one month; any amount you paid in advance for the period after that is refunded pro rata. Prices are shown on the website and, for consumers, include VAT.
5. Demo / trial period
If we offer a trial period (for example 7 days), you can try the software during that period. If you do not cancel before the end of the trial, your paid subscription starts automatically at the stated rate. You stop the trial by cancelling on your licence page at fixturepilot.com/my-license (where you enter your licence code), or otherwise via support@fixturepilot.com.
6. Cancellation
You can cancel your subscription at any time on your licence page at fixturepilot.com/my-license, where you manage your subscription with your licence code. If that does not work, you can also cancel via support@fixturepilot.com. The cancellation takes effect at the end of the current billing period; you keep access until that date. Periods already paid are not refunded, unless the law provides otherwise (for consumers, see article 4).
7. Right of withdrawal (consumers)
As a consumer you generally have a 14-day cooling-off period. For digital products that are delivered immediately, this right lapses once delivery has started, provided you expressly agreed to this at purchase and acknowledged that you thereby waive your right of withdrawal. The mobile app is free; no withdrawal is needed for it.
8. Availability, updates and maintenance
We do our best to keep the software and services available and release updates regularly. We may change, improve or adjust parts of the software from time to time. We cannot guarantee that the software will always work without interruption or errors.
9. Permitted use
You will not use the software for unlawful purposes or in a way that harms our services or those of others. You are responsible for making back-ups of your projects and data. If you share a project with others, for example through a project link, you are responsible for what you share and with whom, and for being allowed to use the recipients' e-mail addresses for this.
10. Use with lighting and network equipment
With the software you control equipment directly, for example through DMX, RDM or network settings. A command can make a fixture move, switch it on or off or reset it, or change the settings of a device or network. You are responsible for using it safely: check what you send, especially when people are nearby or a show is running.
Fixture data (such as channel layouts and modes) and the web pages and settings of devices come from the manufacturers or from you. Check them before you rely on them; we do not guarantee their accuracy. The software contains open-source components, which are subject to their own licences (in the app under About > Open-source licenses).
11. App Store and Google Play
If you download the mobile app from Apple's App Store or from Google Play, the terms of that store also apply; for the App Store this is Apple's standard Licensed Application End User License Agreement (EULA). Apple and Google are not parties to these terms and are not responsible for the app, its maintenance or support. Please send questions and complaints about the app to us.
12. Intellectual property
All rights to the software, the brand name and the content of the website remain with FixturePilot. You only receive a right of use, not ownership. Your own project data remains entirely yours.
13. Beta programme
If you take part in the beta programme, including through TestFlight or the test version on Google Play, you are using software that is still in development. Beta software may contain errors and is provided "as is", without warranties. Your feedback helps us improve the software.
14. Liability
The software is provided "as is". To the extent permitted by law, we are not liable for indirect damage, consequential damage, loss of data or loss of profit, including damage caused by controlling equipment or by incorrect fixture data (article 10), or for failures caused by force majeure, such as outages at our service providers. Our total liability is limited to the amount you paid for your licence in the twelve months before the damage occurred. These limitations do not apply in case of intent or deliberate recklessness on our part, and do not affect your statutory consumer rights.
15. Termination
We may terminate a licence if you seriously or repeatedly breach these terms. On termination your right of use ends; your project data on your own device remains yours.
16. Changes to these terms
We may change these terms. We will tell you about important changes in advance, for example by e-mail or through a notice on the website. The current version is always available on this page.
17. Applicable law
These terms are governed by Dutch law. Disputes will be submitted to the competent Dutch court, unless mandatory law designates another court.
